A New Jersey fifth-grader has found himself on the receiving end of his school's zero-tolerance policy for anything gun-related.According to the Aarin Moody's mother and Fox News, as the student from Atlantic City attempted to pull a late slip out of his backpack, a foam bullet fell to the ground and a teacher promptly reported him for having a weapon, leading to his expulsion, later reduced to a five-day suspension.

The foam dart had a broken toothpick in it--something Moody and his mother claim was to let the darts stick in the ground after he shoots them--which caused it to be labeled something "readily capable of lethal use or inflicting serious bodily injury."

The mother believes the suspension is connected to her having filed a harassment complaint against the board during her tenure as a custodian in the Atlantic City School District.
