Police in Newburgh say they spotted a man holding a gun while fighting with a women. While arresting the man the woman allegedly attacked an officer.

Wednesday around 12:30 a.m., City of Newburgh Police responded to an area of City Terrance and Carter Street for a report of a man with a gun threatening a female with a gun.

Arriving officers say they noticed a male holding a gun in his hand during a physical altercation with a female. When police told the man, later identified as 20-year-old Marcus Simmons, of Newburgh to drop his weapon, he allegedly fled on foot, tossing his weapon during his run.

Simmons was soon taken into custody. While he was being handcuffed the woman that police say that Simmons was previously threatening and fighting with jumped on officer’s backs protesting the arrest.

19-year-old Casandra Ayala, also of Newburgh was pulled off of officers and placed under arrest.

Police say they were able to locate and seize the gun tossed by Simmons, a black Harrington and Richardson .32 caliber revolver.

Both were charged with criminal possession of a weapon, a felony, and resisting arrest, a misdemeanor. Ayala was additionally given a misdemeanor charge for obstructing governmental administration.

Two officers sustained minor injuries.
