A Hudson Valley paramedics conviction for stealing from patients was upheld.

Thursday, the Appellate Division, Third Department unanimously affirmed the October 3, 2014 conviction of German A. Lobaton for 2nd-degree burglary, a class C violent felony.

According to the Ulster County District Attorney's Office, during a four month period in 2013, Lobaton, an Emergency Medical Technician and member of the Ellenville First Aid and Rescue Squad, responded to medical emergencies at three separate homes in Ellenville.

Shortly after, while the homes in question were empty because the residents were at the hospital, Lobaton returned to the residences, and stole a number of items from the home.

Officials say electronic devices, jewelry, handguns and rifles were stolen. When police executed a search warrant at Lobaton’s home, most of the stolen property was found.

Lobaton plead guilty to burglary on a 12-count indictment in 2014. In October of 2014, he was sentenced to the agreed upon term of imprisonment of 13 years in prison followed by five years of post-release supervision.

On appeal to the Appellate Division, Third Department, Lobaton argued that his plea was not knowing, intelligent, or voluntary.

The reviewing court found both claims unpreserved for appellate review.
