A.G. to Investigate Fatal Police Shooting at Hudson Valley Eatery

The state attorney general's office is going to investigate the death of a Hudson Valley man who was fatally shot by a police officer.

On Tuesday around 11 a.m., State Police in Poughkeepsie and Dutchess County 911 received a call which reported a drunk man with a knife was threatening a woman at Coyote Flaco Restaurant in Stanfordville.

New York State Police soon found 41-year-old Jaime Lopez Cabrera of Standfordville next to the driver’s door of a car occupied by a woman, police say.

When the 41-year-old made what police describe as an "aggressive movement" towards the officers, trooper Wolensky fired two shots, striking Lopez Cabrera, officials say.

Lopez Cabrera was taken to Mid-Hudson Regional Hospital where he later died. The woman inside the car wasn't injured, according to police.

On Thursday, the Dutchess County District Attorney's Office received notice that the New York State Attorney General exercised their jurisdiction over the investigation into the death.

"Executive Order #147 in essence 'requires' the New York State Attorney General to investigate and prosecute, if warranted, cases where a law enforcement officer causes the death of an unarmed civilian or there is a significant question as to whether the civilian was armed and dangerous at the time of his or her death," Dutchess County District Attorney William V. Grady wrote in a press release.
