A Hudson Valley mother wont serve jail time in connection with the Easter 2015 death of her 6-year-old daughter.

On April 5, 2015, Easter Sunday, Croton-on-Hudson Police received a 911 call from David Carr, the father of the victim, requesting that police come to 144 Hasting Avenue in the Village of Cronton-On Hudson. The father reported that his daughter felt cold and was not breathing.

Officials arrived at the home and discovered 6-year-old Lacey Carr unresponsive and not breathing. The mother, 53-year-old Kathleen Dymes, was found in a kneeling position on the floor, also unresponsive.

Lacey Carr was soon pronounced dead. Reports say the child had morphine and other drugs in her system.

Police executed a search warrant later that day were the child had died and found an open bottle of alcohol, along with various and many over the counter, prescription, and illegal drugs scattered around the bedroom. Police also found two handwritten suicide notes in the room.

In January, Dymes plead guilty to criminally negligent homicide, misdemeanor child endangerment and possession of a controlled substance. She faced a maximum sentence of 4 years in prison. But Judge Barbara Zambelli was prepared to show mercy, saying Dymes suffered enough.

In Westchester County Court Tuesday, Dymes was sentenced to 5 years probation.
