State Police say a man was killed on Route 84 on Saturday after he was struck by a car while retrieving a baseball.

According to the New York State Police in Middletown, the fatal accident happened on Route 84 near exit 3E in the Town of Waywayanda. Troopers say that on Saturday evening a 35-year-old man from the Bronx identified as Nicholas Barba was waiting for a tow truck after his vehicle became disabled.

While waiting for assistance, Barba was playing catch with his son. At one point the ball sent across Route 84 and onto the median. An investigation by the State Police says that Barba went to retrieve the ball and on the way back to his son, was hit by a car in the right lane.

Troopers say the car stopped at the scene and that no charges are expected.
