Governor Cuomo thinks that you should not be able to have this and the FAA wants to put some new rules in place about it too. 

Governor Cuomo says e-cigarettes should not be able to go where conventional cigs can't. According to the governor’s office, he wants to see the state extend its smoking ban to the electronic devices, which produce vapor instead of smoke and don't typically contain tobacco, but often have nicotine.  Cuomo says he also wants to limit marketing of e-cigs to ensure companies aren't trying to hook kids or young adults.

The Governor is not alone, the airlines are adding a new item to their list of hazardous items that don't belong in checked baggage, and that's e-cigarettes.  The FAA is warning air carriers that e-cigs in the cargo compartment can pose a fire hazard and wants airlines to inform passengers about this as often as possible.  The FAA is not banning e-cigs on planes just yet. They are asking passengers to carry them onto the plane, not to check them in their luggage. An international aviation group says there have been several incidents where e-cigarettes overheated or caught fire inside luggage when the heating element was accidentally activated.
