The New York DMV currently states that the legal blood alcohol limit cannot exceed .08%. Anything over that amount is punishable.

According to the New York Daily News, Assemblymen from both Brooklyn and Queens want lower the limit. It's their hopes to have it lowered to .05% with a new proposed bill. The two politicians describe it as "common sense legislation."

MADD reports that New York roughly 11,000 deaths from drunk driving accidents in 2016 and 2017.

Utah has had a .05 BAC limit for years. Their alcohol related driving deaths were reported to be 36 in 2017.
